JOHN W. TUMELTY: In my experience as a former prosecutor, I’ve been a former state prosecutor and then assistant county prosecutor. And I handled every imaginable kind of drug case. That experience I think is invaluable when I defend clients that are charged with drug crimes. Everybody charged with a drug offense, even the more serious down to the not-so-serious possession for personal use, their criminal offense is their crimes. And there’s always the potential for a criminal record that can have consequences down the road. If somebody’s found guilty of a drug crime in New Jersey, there’s a mandatory loss of driving privileges, anywhere from six months to two years. Almost all drug cases involve a police officer searching in my client’s car, pocketbook, my client’s house.

And the general rule is that the police need a warrant before they can search anything anywhere because if the search was illegal, the evidence can be suppressed. Everything I do for a client is geared toward avoiding my client from getting a criminal record. A criminal record, especially for a felony conviction can have tremendous consequences down the road. It can affect employment, job applications, state licensing applications, college, graduate school, you name it. There’s background checks on everything in this day and age.
