Mr. Tumelty represented Helena Hendricks, who was charged with first degree murder in Atlantic County Superior Court. If You Are Convicted of DWI

Beyond the New Jersey DWI penalties, commercial vehicle drivers are subject to the Federal Motor Carrier Safety Act (FMCSA), which defines DUI/DWI as a blood alcohol concentration (BAC) of .04 percent.

  • First DWI conviction in a passenger vehicle:
    • Three- to 12-month driver’s license suspension
    • One-year suspension of CDL
  • Second DWI conviction in a passenger vehicle:
    • Two-year driver’s license suspension
    • Permanently revoked CDL
